These conditions of participation regulate the conditions for participation in the Schierker Feuerstein vacation apartment competition "15 vacations at the parent company" hereinafter referred to as the "Apartment Competition", as well as any necessary transfers of rights.

The organizer of the competition is SCHIERKER FEUERSTEIN GmbH & Co. KG, Schierker-Feuerstein-Platz 1-5, 37431 Bad Lauterberg, hereinafter referred to as Schierker Feuerstein.

By participating in the apartment competition, these conditions of participation are accepted.

All natural persons over the age of 18 and resident in Germany are eligible to take part in the apartment competition.

Participation with fake identities or identities of third parties is not permitted.

Each person may only take part in the competition once. Multiple entries are not permitted.

Also excluded are employees of Schierker Feuerstein and affiliated companies as well as relatives of such employees and their relatives.

Participation via automated mass participation procedures of third parties is not permitted.

Schierker Feuerstein reserves the right to exclude participants from the competition in the event of a breach of the conditions of participation or if the use of unauthorized aids or manipulation is suspected. Persons who provide false or incomplete personal information will also be excluded. The same applies to persons who violate laws or the rights of third parties in connection with participation. Schierker Feuerstein may also subsequently pronounce such an exclusion, revoke prizes and/or reclaim them.

The apartment competition starts on April 1, 2025 and ends on December 31, 2025, 11:59 p.m.

Schierker Feuerstein is giving away a total of 15 vacations in the three Schierker Feuerstein vacation apartments in the Schierker Feuerstein main building in Schierke (address: Schierker Feuerstein GmbH & Co KG, Brockenstraße 3, 38879 Wernigerode OT Schierke) and 35 Schierker barbecue packages.

The following prizes will be raffled off as part of the apartment competition:

Vacations:

1 x 7 nights for up to 6 people incl. use of the sauna

1 x 7 nights for up to 4 people incl. use of the sauna

1 x 7 nights for up to 2 people

Short vacations:

6 x 4 nights for up to 4 people incl. use of the sauna

6 x 3 nights for up to 2 people

Grill packages:

All participants have the chance to win 1 of 35 barbecue packages, consisting of 1 x barbecue sauce and 1 x mustard.

The vacation price includes the cost of the vacation apartment (rent), the final cleaning, the rental fee for towels and bed linen (linen package), the electricity costs and the sauna usage fee if a sauna is available.

Not included in the price are the costs of the deposit that must be paid for the respective vacation apartment for the duration of the stay or other costs and fees, such as costs of arrival and departure, visitor's tax, charges for meals or activities of all kinds on site and other fees.

The prize is not transferable to third parties and cannot be paid out in cash. 

Participants can access the campaign page via the QR code on the bottle tag or via www.schierker-feuerstein.de/gewinnspiel. In the competition form, participants are asked to enter their personal data (first and last name, street/no., postcode/city, e-mail address) to enter. For the matching draw, participants must also select which vacation or short break they would like to win.

The present conditions of participation must also be accepted.

Before taking part, it is advisable to take a look at the Schierk vacation apartments on the website. The three vacation apartments differ in terms of size, facilities and occupancy options. A detailed description of each vacation apartment can be found at: www.schierker-feuerstein.de.

Participation is free of charge and is not linked to the purchase of a product. Participants only have to pay the fees for the internet connection. Schierker Feuerstein is not liable for the availability of the website. Schierker Feuerstein is also not liable for any transmission errors.

Participation is possible until 31.12.2025, 23:59.

The draw will take place after of the campaign until January 15, 2026.

The vacations and short breaks will be drawn at random after the closing date among those who have made the respective selection. The winners will be notified by e-mail after the draw and will receive a confirmation for the respective vacation. This prize notification will be sent to the e-mail address provided by the participants when taking part. Schierker Feuerstein is not obliged to make any further inquiries in the event of an undeliverable prize notification. In the event of undeliverability, the claim to the prize expires.

The barbecue packages will be raffled off among all participants and sent to the winners by post to the specified address within Germany. The risk is transferred to the winner when the prize is handed over to a carrier. Schierker Feuerstein cannot be held responsible for delivery damage. If the delivery cannot take place due to incorrect or incomplete information of the name or address, Schierker Feuerstein is not obliged to make further inquiries. In the event of non-delivery, the claim to the prize expires.

The prize is not transferable, nor can it be exchanged or paid out in cash.

The vacation can be redeemed from the date of the confirmation information up to and including 30.06.2027. The period of stay must fall within this validity period. A booking can only be made if the respective vacation apartment has free capacity. Public holidays are always excluded.

The number of occupants may be reduced by arrangement, but not exceeded.

The vacation prize comprises a defined number of days, these days must be redeemed in one go and cannot be split over several stays. If the length of stay is shorter than the number of nights won, the remaining nights will be forfeited without replacement.

When the winning stay is booked, a rental agreement is concluded between Schierker Feuerstein GmbH & Co KG in 38879 Wernigerode OT Schierke and the winner for the free use of the vacation apartment, which regulates the proper use of the apartment, such as rental period, arrival and departure, deposit, key handover, parking arrangements, etc.

The winner must pay a deposit by bank transfer before arrival. This will be refunded within 7 days of the end of the rental period if not used.

If the participants upload photos to Schierker Feuerstein's social media channels following the competition, the participants guarantee that no content will be sent whose provision, publication or use violates applicable law or the rights of third parties.

The participants indemnify Schierker Feuerstein from claims of third parties of any kind resulting from the illegality of photos used by the participants. The indemnification obligation also includes the obligation to fully indemnify Schierker Feuerstein from legal defense costs (e.g. court and attorney's fees).

Schierker Feuerstein is released from all obligations upon redemption of the won vacation and dispatch of the barbecue packages, unless an earlier point in time results from these regulations. Schierker Feuerstein is only liable for damages caused by Schierker Feuerstein or one of its vicarious agents intentionally or through gross negligence or through the negligent breach of obligations that are essential for achieving the purpose of the contract. The above limitations of liability also apply in particular to damage caused by errors, delays or interruptions in transmission, faults in the technical systems and service, incorrect content, loss or deletion of data or viruses. These limitations do not apply to damages caused by injury to life, body and/or health or to liability under the Product Liability Act. Schierker Feuerstein assumes no liability for the freedom from defects of the products of other manufacturers.

Schierker Feuerstein reserves the right to prematurely terminate the competition in whole or in part at any time, even without observing deadlines, or to change the course of the competition if it is not possible for technical (e.g. computer virus, manipulation of or errors in software/hardware) or legal reasons to guarantee the proper execution of the competition or if other reasons would disrupt or prevent the competition from running as planned.

The personal data collected will be used exclusively for the purpose of the competition and will be deleted after the redemption period (01.07.2027 at the latest). The legal basis is Art. 6 (1) lit. b) GDPR. We draw your attention to your rights pursuant to Art. 15 et seq. GDPR and your right to lodge a complaint pursuant to Art. 77 GDPR. Participants can request information about the personal data stored about them at any time. We only transfer the data to our service providers who help us to run the competition, such as agencies, shipping companies and IT service providers. With regard to other data processing (including recipients, transfer to third countries), please note the Privacy policy at www.schierker-feuerstein.de.

 By participating in this competition, the participant accepts these conditions of participation.

Should the conditions of participation contain ineffective provisions, the effectiveness of the remaining conditions shall remain unaffected and the ineffective conditions shall be replaced by a condition that comes as close as possible to the original purpose of the ineffective condition. The same applies in the event of a loophole in these conditions of participation.

German law applies. Legal recourse to review the draw is excluded. The law of the Federal Republic of Germany shall apply exclusively, to the exclusion of the provisions of international private law and the UN Convention on Contracts for the International Sale of Goods, insofar as this does not conflict with mandatory statutory provisions.
